Terms & Conditions
I am an artisan chocolatier. All my chocolates are handmade by me and I would like you to find the same joy in eating or gifting them as I find in creating them, but should there be a problem contact me at email@example.com
2. ORDERING FROM ME
2.1 You are deemed to place an order with me by ordering via my online checkout process. As part of that checkout process you will be given the opportunity to check your order and to correct any errors. I will send you an order acknowledgement, detailing the products you have ordered.
2.2 My acceptance of an order takes place when I dispatch the order. I will send you a dispatch confirmation by email. When I dispatch the order, the purchase contract will be made even if your payment has been processed immediately, unless I have notified you that I do not accept your order or you have cancelled your order.
2.3 I may refuse to accept an order:
(a) where goods are not available;
(b) where I cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error.
3.1 All prices include VAT (where applicable) at the current rates.
3.2 Where I charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in my specified pricing structure shown on the Website.
3.3 My prices are reviewed periodically and subject to change.
4. CANCELLATION AND RETURNS POLICY
4.1 If you wish to cancel your order:
(a) you can notify me by email before I have dispatched the goods to you; or
(b) where goods have already been dispatched to you, by returning goods to me in accordance with clause 4.2 below.
4.2 You may cancel your chocolate order up to and within 14 days of delivery (commencing the day after goods have been received by the customer) in accordance with the Distance Selling Directive (2000). A refund will be made, excluding postage, within 14 days of cancellation. All items shall be returned at the customers cost. Returned chocolates must be in perfect condition and un-opened and be returned to us using a recorded delivery. Returned items must be checked by us on arrival to be in perfect condition for re-sale and any breakages or damages can not be refunded.
4.3 Within 14 calendar days of receipt of the returned goods (or proof of posting), I will give you a full refund of the amount paid or an exchange credit as required.
4.4 The right to return the goods to me as referred to in clause 4.3 will not apply in the event that the product is not returned in its original state or has been made to the customers individual specification.
4.5 If you find fault or defect with my products, then I would ask you to telephone me immediately or email me in order that appropriate action may be taken to expedite a speedy resolution to the situation. This does not affect your statutory rights.
5. GOVERNING LAW AND JURISDICTION
5.1 These terms and conditions shall be governed by and construed in accordance with English law (and where applicable, European law). Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
5.2 I do not warrant that items for sale on this Website are appropriate or available outside of the United Kingdom.
